Peran Pengadilan Agama Marabahan Untuk Menjamin Hak Istri Pada Pelaksanaan Pembayaran Nafkah Iddah Dan Mut’ah Dalam Putusan Cerai Talak Verstek

Abstract

In cases of divorce, both under Islamic law and positive law, there are certain rights and obligations that must be fulfilled by both former spouses. These include maintenance after divorce, which the former husband must provide, and the iddah period that the former wife must observe, during which she is entitled to iddah maintenance. When the divorce process is carried out through the court, there are procedures to be followed, such as registering the case and undergoing trial. However, sometimes a respondent or defendant may not be present, leading to a verstek, or default, decision. This research explores a case at the Marabahan Religious Court where the former wife did not receive her rights, even though they were stipulated in the divorce verdict. The court plays a role in ensuring the fulfillment of women's rights after divorce, but there are obstacles that arise, mainly from the former wife or respondent. While the court's role in guaranteeing the wife's rights in the payment of iddah alimony and mut'ah maintenance has been carried out according to regulations, external factors still hinder the fulfillment of these rights.

Abstrak

Dalam kasus perceraian, baik dalam hukum Islam maupun hukum positif, ada beberapa hak dan kewajiban yang harus dipenuhi oleh mantan pasangan. Hal ini termasuk nafkah setelah perceraian yang harus diberikan oleh mantan suami, dan masa iddah yang harus dijalani oleh mantan istri, di mana ia berhak mendapatkan nafkah iddah. Ketika proses perceraian dilakukan melalui pengadilan, ada prosedur yang harus diikuti, seperti mendaftarkan perkara dan menjalani persidangan. Namun, terkadang pihak tergugat atau tergugat tidak hadir, sehingga menyebabkan putusan verstek, atau putusan verstek. Penelitian ini membahas sebuah kasus di Pengadilan Agama Marabahan di mana mantan istri tidak mendapatkan hak-haknya, meskipun hak-hak tersebut telah ditetapkan dalam putusan perceraian. Pengadilan berperan dalam menjamin terpenuhinya hak-hak perempuan pasca perceraian, namun terdapat hambatan yang muncul, terutama dari pihak mantan istri atau tergugat. Meskipun peran pengadilan dalam menjamin hak-hak istri dalam pembayaran nafkah iddah dan nafkah mut'ah telah dilakukan sesuai peraturan, namun faktor eksternal masih menghambat pemenuhan hak-hak tersebut.
