This situation requires law enforcement officials to reorganize their work without sacrificing citizens' rights. This study examines the role of law enforcement in maintaining post-pandemic security and order, assesses the suitability of their actions with Islamic law, and maps challenges as well as models of strengthening. The study uses normative juridical&nbsp; methods with legislative, comparative, conceptual, and policy approaches. Secondary data from the literature study were analyzed descriptive-qualitatively through content analysis. The results show that the apparatus carries out preventive, repressive, and restorative functions that are tied to the due process of law. However, practices in the field are not fully aligned with the principles&nbsp; of al-'adl, maṣlaḥah, and maqāṣid al-syarī'ah because authority is still often used excessively. Structural barriers include rigid regulations, limited personnel and budgets, and weak coordination. Cultural barriers are seen in declining citizen compliance and resistance, while substantive barriers arise from digital crime and inequality in law enforcement. The study concludes that the combination of positive law, criminology, and Islamic law results in a strengthening model that relies on adaptive regulation, capacity building of the apparatus, and humanist and restorative approaches.</p> </td> </tr> </tbody> </table> Boy Sutan Binanga Siregar, Kasful Anwar Us, Yuliatin Yuliatin Copyright (c) 2026 https://creativecommons.org/licenses/by-nc-sa/4.0 https://mail.shariajournal.com/index.php/IERJ/article/view/2060 Mon, 12 Oct 2026 00:00:00 +0000 Optimizing the Application of Restorative Justice in Criminal Case Resolution in the Jambi District Court in the Perspective of Islamic Law https://mail.shariajournal.com/index.php/IERJ/article/view/2061 <table> <tbody> <tr> <td> <p>The settlement of criminal cases in Indonesia is still dominated by a retributive approach that is oriented towards punishment, so that the role of victims is often neglected and the burden of cases in the courts continues to increase. This condition encourages the need for a more humane alternative settlement through&nbsp; a restorative justice approach, especially in the Jambi District Court which has begun to accommodate this concept through various Supreme Court regulations. This research aims to analyze the form, mechanism, and constraints of the application&nbsp; of restorative justice in criminal cases in the Jambi District Court, as well as formulate an optimization model through the perspective of Islamic law. This study uses a qualitative method with a juridical-empirical approach. Primary data was obtained through in-depth interviews with the Deputy Chief Justice of the Jambi District Court, judges, prosecutors, investigators, community leaders, religious leaders, legal academics, and victims of crimes, while secondary data was collected from decision documents, laws and regulations, and relevant Islamic legal literature. Data analysis was carried out in a descriptive-analytical manner by linking field findings with restorative justice theory and the concept&nbsp; of maqāṣid al-syarī'ah. The results of the study show that the implementation&nbsp; of restorative justice in the Jambi District Court has been running, but it is still limited to certain cases and faces juridical, structural, and cultural obstacles, especially in the form of regulations that are not synchronized and the retributive paradigm is still strong among law enforcement officials and the community. The discussion emphasized that the values&nbsp; of islah, 'afw, diyat, and qishas in Islamic law have a strong conformity with the principle of restoration in restorative justice, so that the integration of the two has the potential to strengthen the moral and social legitimacy of their application. This study concludes that the optimization of restorative justice in the Jambi District Court requires strengthening regulations, the capacity of judges as facilitators, and the integration of Islamic law values as a moral foundation in realizing substantive justice that is oriented towards benefit.</p> </td> </tr> </tbody> </table> Yumika Putra, Bahrul Ulum, Fuad Rahman Copyright (c) 2026 https://creativecommons.org/licenses/by-nc-sa/4.0 https://mail.shariajournal.com/index.php/IERJ/article/view/2061 Mon, 12 Oct 2026 00:00:00 +0000 Analysis of the Quality of Law Enforcement Against Corruption Crimes in Indonesia: A Review of the Latest Year's Cases in the Perspective of Islamic Law https://mail.shariajournal.com/index.php/IERJ/article/view/2062 <table> <tbody> <tr> <td> <p>Corruption is an extraordinary crime that undermines public trust in the state and the law, so its handling requires synergy between law enforcement officials, institutions, and community participation. Although Indonesia has a legal umbrella in the form of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001, the practice of corruption is still constrained by structural, political, and cultural problems. This study aims to examine the quality of law enforcement of corruption crimes in the Jambi Corruption Court in the current period, the factors that affect it, and provide a review from the perspective of Islamic law. The research uses a qualitative approach combined with normative juridical studies, with data collection through semi-structured interviews, observations, literature studies, and documentation, then tested for validity through triangulation of sources and theories. The findings show that the handling of cases at the Jambi Corruption Court is quite good, supported by the independence of judges, openness of trials, and relatively consistent criminal patterns, although it is still overshadowed by administrative constraints, limitations of ad hoc judges, and disparity in verdicts. Its effectiveness is influenced by the legal substance, institutional structure, infrastructure, and legal culture of the community. From the point of view of Islamic law, the practice of the judiciary is in line with the principles&nbsp; of al-'adl and amanah and rejects ghulul, risywah, and treason, but the recovery of state losses has not fully reflected&nbsp; the maqashid of sharia. Research suggests the addition of ad hoc judges, more detailed sentencing guidelines, and the strengthening of Islamic values in anti-corruption policies.</p> </td> </tr> </tbody> </table> Riko Budiman, Mukhtar Mukhtar, Hermanto Harun Copyright (c) 2026 https://creativecommons.org/licenses/by-nc-sa/4.0 https://mail.shariajournal.com/index.php/IERJ/article/view/2062 Mon, 12 Oct 2026 00:00:00 +0000 Enforcement of Satisfaction Decisions in the Jambi Corruption Court: Normative Analysis through the Lens of Islamic Criminal Law https://mail.shariajournal.com/index.php/IERJ/article/view/2063 <table> <tbody> <tr> <td> <p>Indonesia’s constitutional commitment to the rule of law requires every exercise of public authority to be lawful, equal, and accountable; however, persistent gratification offenses convert public office into a private commodity and thereby erode institutional legitimacy. This study analyzes the enforcement of gratification judgments at the Jambi Corruption Court, examines the ratio decidendi underlying judicial sanctions, and evaluates that process through Islamic criminal law (fiqh jinayah) in order to construct an integrative model of justice. Employing a normative-empirical qualitative design, three final and binding judgments were examined through doctrinal content analysis aligned with maqasid-based Islamic legal theory. The findings show that, although the judgments satisfy formal legality and evidentiary sufficiency, their execution reveals a persistent gap between law in the verdict and law in implementation, while judicial reasoning remains formalistic, distinguishing offenders by institutional visibility rather than by an explicit doctrine of proportional culpability rooted in the breach of amanah. Viewed through risywah, ghulul, hadiyyat al-‘ummal, and jarimah ta’zir, gratification constitutes a multidimensional violation of public trust. The study concludes by proposing an integrative model that synthesizes legal, moral, and public justice, and recommends that judges explicitly incorporate breach of trust as an aggravating factor, while enforcement authorities apply monitored and transparent restitution mechanisms.</p> </td> </tr> </tbody> </table> Taufan Junaidi, Husein Rintonga, Hermanto Harun Copyright (c) 2026 https://creativecommons.org/licenses/by-nc-sa/4.0 https://mail.shariajournal.com/index.php/IERJ/article/view/2063 Mon, 12 Oct 2026 00:00:00 +0000
